Privacy Policy

This Privacy Policy explains how NEXOCON Enterprises Inc. collects, uses, and protects your personal information in connection with nexocon.com, the NEXOCON Pro.Series™ subscriber platform, and our direct client services. By using our website or services, you consent to the practices described in this policy.

1. Who We Are

NEXOCON Enterprises Inc. (“NEXOCON,” “we,” “us,” or “our”) is a quantity surveying and construction cost consulting firm incorporated under the laws of British Columbia, Canada, operating at nexocon.com and through the NEXOCON Pro.Series™ subscriber platform.

We are responsible for the personal information we collect, use, and disclose in the course of operating our website and platforms. Questions or requests regarding this Privacy Policy may be directed to our Privacy Contact identified in Section 11.

2. Scope of This Policy

This Privacy Policy applies to personal information collected through:

  • nexocon.com and all associated subdomains
  • NEXOCON Pro.Series™ subscriber portal
  • NEXOCON Client Portal (project report delivery platform)
  • Contact forms on nexocon.com
  • Email correspondence with info@nexocon.com

It does not apply to information collected by third-party services we link to, or to personal information collected solely in the context of our direct client engagements (quantity surveying and cost consulting), which are governed by separate engagement agreements.

3. What Personal Information We Collect

We collect only the personal information necessary to operate our platforms and deliver our services.

3.1 — Account and Identity Information

  • Full name
  • Email address
  • Account username and encrypted password

3.2 — Payment Information

Credit or debit card details are processed and stored exclusively by Stripe Inc. NEXOCON does not store card numbers, CVV codes, or full card details on its own systems. We retain only the last four digits of your card and card type for billing reference purposes, along with billing address (if provided) and transaction history.

3.3 — Usage Information

  • Content pages accessed and viewed
  • Subscription tier, purchase date, and renewal history
  • Browser type, device type, and operating system (collected automatically via server logs)
  • IP address and approximate geographic location derived from IP

3.4 — Communication Information

  • Emails and messages you send to info@nexocon.com
  • Contact form submissions

3.5 — Information We Do Not Collect

We do not collect sensitive personal information such as government identification numbers, Social Insurance Numbers, health information, or financial account credentials other than as described in Section 3.2.

4. How We Use Your Information

We collect and use personal information for the following purposes:

5. Cookies and Tracking

Essential cookies are required for login sessions, subscriber authentication, and access control. These cannot be disabled without preventing platform functionality.

Performance cookies are used to understand how visitors navigate the platform so we can improve the user experience. These collect aggregated, non-identifiable information.

We do not use third-party advertising cookies or tracking pixels. You may manage cookie preferences through your browser settings. Disabling essential cookies will prevent you from accessing subscriber or client content.

6. Third Parties We Share Information With

We share personal information only with the following service providers, and only to the extent necessary to operate our platforms:

Each provider is bound by its own privacy policy and, where applicable, a data processing agreement. Where information is transferred outside Canada, we rely on those providers’ adherence to applicable data protection standards including those recognised under PIPEDA Schedule 1.

We do not share personal information with any other third party without your consent, except where required by law or court order.

7. Data Retention

We retain personal information for as long as your account is active and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce our agreements:

Up to 12 months on a rolling basis

When personal information is no longer required for its stated purpose and retention period, it is securely deleted or anonymized.

8. Security

We take reasonable technical and organizational measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. These measures include:

  • Encrypted HTTPS connections for all platform access
  • Encrypted storage of account passwords (hashed and salted)
  • Payment processing exclusively through Stripe’s PCI-DSS compliant infrastructure — NEXOCON never handles raw card data
  • Access to subscriber and client data restricted to authorized NEXOCON personnel

No transmission over the internet is completely secure. While we take reasonable precautions, we cannot guarantee absolute security. In the event of a privacy breach that creates a real risk of significant harm, we will notify affected individuals and the Office of the Privacy Commissioner of Canada as required under PIPEDA.

9. Your Rights

Under PIPEDA and BC’s PIPA, you have the following rights. To exercise any of these rights, contact us using the details in Section 11. We will respond within 30 days and may require identity verification before processing your request.

Access

Request a copy of the personal information we hold about you.

Correction

Request that we correct inaccurate or incomplete personal information.

Withdrawal of Consent

Withdraw consent to uses of your personal information not required for platform operation or legal compliance. Note that withdrawal of consent to essential processing (such as billing) will require account termination.

Deletion

Request deletion of your personal information, subject to our legal retention obligations. Deletion requests will be fulfilled within 30 days except where retention is required by law.

Complaint

Lodge a complaint with the Office of the Privacy Commissioner of Canada at priv.gc.ca or the Office of the Information and Privacy Commissioner for BC at oipc.bc.ca.

10. Children’s Privacy

NEXOCON’s platforms are intended for construction industry professionals and are not directed at individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has created an account, please contact us immediately and we will delete the account and associated information.

We will acknowledge your inquiry within 5 business days and respond fully within 30 days. If a 30-day response is not feasible, we will notify you of the extended timeline.

12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. Material changes will be communicated by email to your registered address or by prominent notice on the platform at least fourteen (14) days before taking effect. The “Last Updated” date at the top of this document reflects the most recent revision. Your continued use of our platforms after the effective date of any revision constitutes acceptance of the updated Privacy Policy.

13. Governing Law

This Privacy Policy is governed by the laws of the Province of British Columbia and the federal laws of Canada, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and BC’s Personal Information Protection Act (PIPA). Any disputes arising from this Privacy Policy shall be subject to the jurisdiction of the courts of British Columbia.
